Terms and Conditions   This Agreement is an English language legal document which sets out your rights and obligations, and those of BETPLAYER Limited, a company registered in England under registration no. 5828557. By registering for the eDuel.net Service, you agree to the terms of this Agreement, and you re-affirm that agreement every time you use it. Visitors to the eDuel.net Service who do not register to become a Member (see below) similarly affirm that they are bound by this Agreement each time they access the eDuel.net Service. We do not separately file the individual Agreements entered into by Members. However, you can access the Agreement using the link to our Terms and Conditions on the Support Page of the eDuel.net Service and print it off, should you so wish. You should be aware that this Agreement may change from time to time.   The eDuel.net Website offers a gambling platform to compete with different players in stages or tournaments. General   1.1. Types of members: eDuel.net differ between guests and „DuelPlayers“. Guests may use the gambling services of eDuel.net in a limited manner. Only DuelPlayers can attend Challenges or tournaments to win money.   1.2. Registration: Usage of eDuel.net’s services requires registration. Registration is for both guests and DuelPlayers free. There is no enforcable claim for any to registration. BETPLAYER Ltd. may refuse registritation itself and the registration as a guest or a DuelPlayer without giving any reasons. BETPLAYER Ltd. may revoke or cancel a registration by e-Mail with good reason, e.g. multiple registration, fraud or fraud-alike behaviour, a low degree of creditworthiness of the DuelPlayer.   1.3. User name: The user name must not contain the e-Mail- or internet-address. It must not infringe any rights of a third party or morality.   1.4. More information about games, Challenges, rules, and procedures can be found at the website of eDuel.net. 1.5. Range of use   1.6. Requirements of use: Users may attend games provided by eDuel.net. Usage may depend on your membership (whether it is a guest membership or a DuelPlayer membership), your age (due to adult content), proof of payment, number of attended games.   1.7. Restricted use: Usage of eDuel.net and its services is limited by state-of-the-art. Limitations may occur due to technical breakdowns, especially disruption of telecommunication or power, hard- or software bugs not provoked by BETPLAYER Ltd.   1.8. Time of maintenance: Times of Maintenance are necessary to protect security and integrity of the servers. If maintenance has to be done, users will be informed about. In time of maintenance some or all functions of the eDuel website can be down and will not be available.   2. Registration   2.1. Registration at eDuel.net: To participate as DuelPlayer it is necessary to give full particulars and to pay in a certain amount of money in Euros. The inpayments and gains and losses will be administered by BETPLAYER Ltd. under the title of the user’s account by order of the user without any interests for the user.   2.2. Restriction of usage: Only persons who are unlimited contractually capable may register. Persons who are under legal age, i.e. 17 years or younger, are not allowed to attend Challenges or tournaments on eDuel.net. We reserve ourself the right to establish an age-verification-system.   2.3. Statements of the user: All data demanded by us must be complete and proper. Demanded data is a valid e-Mail-address, a valid username, a valid password, the date of birth, and a valid postal address. If the user is a DuelPlayer he or she has to provide his or her bank data, his or her mobile number. Optional data provided is the fixed subscriber number. Eventually is ID-Data has to be given by the user. User may not claim a particular username or password. Age verification may be passed by conclusiveness of data given by the user. If the user is not the bearer of an ID-Card of the Federal Republic of Germany we will contact him or her to verify the user’s age. If the data provided by the user is not proper, we reserve our right to suspend the user’s membership at once and deny the pay out the gains or the current amount of the user’s account.   2.4. Password: The password may not be identical to the username. The user may change his password later on. The password should not be a sequence just of numerics or just of letters but a letter-figure combination. Special characters are applicable. The password has to be kept secret by the user. It should be changed from time to time (at least every second month). If the user infringes this due diligence and a third attends games or disposes for him, every effect will be at the expense of him or her.   3. User account   3.1. Every user may only disclose one user account. Therefore an e-mail-address or password may only be used once. A banking account may only refer to one user account. An IP-address may only refer to one user account. Any user may only participate by his or her user account. A user account is not transferable, not marketable and not negotiable.   If the user is suspected of disclosure of more than one user account, we are allowed to shut down all concerning amounts. In this case we are also allowed to adjust the user’s classification and to exercise our rights due to ss. 6 to 8.   3.2. Change of data: If data is subject to change, the user will have to change his data immediately or inform us by mail.   3.3. Deletion: The user account will be deleted without giving reasons if twelve months has been passed since his or her last log in. By deleting the account the contract between us and the user expires. Before deletion the user will be informed by at least three e-mails. If the user does not give an alternate banking account, the we will authorise the payment of the user account’s assets to the last known user’s banking account. If the payment is not possible, the amount will be transferred to a general account until the payment is possible. Prescription term of this claim is three years.   3.4. Payout: if the amount is more than 10.00 Euro and six weeks passed since the user’s pay in, the DuelPlayer is allowed to claim a pay out twice a month. The pay out will be remitted for the amount payable to account of a German bank. By the Remittance we are cleared off debts.   3.5. Accumulated Gains: If the user account exceeds the amount of 1000,00 Euro, we will pay out the Sum between the current amount and 1000 Euro. This limit of 1000 Euro is subject to change without giving reasons by us. Incidentally the rules in s. 3.4 will affect.   3.6. Legitimation Check: In particular cases we may check the legitimation of the user. In this cases the user is obliged to send a copy of his ID-card or his passport and a written claim of pay out.   3.7. Disbursement of 500 Euro and more: If the amount of pay out exceeds 500 Euro, the user will have to send a copy of his passport or his ID-card and a written confirmation of his banking data by himself. In this cases the name and the date of birth has to be identical to the registration data.   4. Bets and Gains   4.1. Bets: By participating in a Challenge the user authorises us to debit his banking account with the fees (cf. s. 5.7) and the amount which is fixed before the game starts. The fees will be payed out to us and the gains from the gain to the winner. All bets will be payable by the participation of a Challenge or a tournament. The bets are genuine money. If the user’s banking account is without sufficient funds, he or she may not participate in the game.   4.2. Gains: The possible gains are displayed at the beginning of the game exceptionally those games with progressive gains (e.g. jackpot tournaments). The amount of gains in games with progressive gains depends on the number of DuelPlayers and the frequency of their participation. If there are too many participants in a tournament all action to announcing the winner may last up to five days. This term is needed to verify the results and prevent abuse.   4.3. We are allowed to recall any incorrect pay out as soon as the fault is recognised.   5. Pay in and Fees   5.1. Pay in: Every pay in has to be done into the account we specify. Simultaneously to the pay into the account is allowed to participate in Challenges and tournaments with possible gains. We are revocably authorised but not obliged to accept payments by credit card, by debit entry or any other payment procedure and / or allow the user to attend Challenges or tournaments before payment. By payment the user affirms the user to fulfill any our claims of consideration (s. 675 BGB [i.e. Bürgerliches Gesetzbuch = German civil law]) or reimbursement of expenses (s. 670 BGB) or damages, if necessary by bail (ss. 232f. BGB).   5.2. Payment by debit entry: The user authorises us collect the certain amount by debit entry. The user does irrevocably accept his or her data circulated from us or our vicarious agent to the bank and vice versa if the debit entry fails. The data may contain his or her name, his or her date of birth and his or her address. He or she agrees to storage of his or her data until the debit entry succeeds.   5.3. State of payment: Amounts are paid, if these amounts are booked to our account irrevocably and also booked to the account of the abetted user.   5.4. Reason for payment: The declared reason of payment has to be the provided text by the eDuel-system. Any endorsements are feigned not to be made. When booked to the collective account the amount will be credited the according benificiary.   5.5. Special charges for payment transactions: If the user causes any special charges for payment transaction in particular return debit or international credit transfer or the like, we will be authorised to debit the user’s account with these expenses. We will debit the users account for any payment return with 12,00 Euro per payment return and additionally 3,50 Euro per reminder. Any disadvantage caused by the user may be claimed damages from the user. If a return debit arises due to circumstances caused by the user, we are authorised to mandate a debt collection agency and to assign some or all claims against the user.   5.6. Credit assessment: We reserve our rights to check the user’s creditworthiness. For checking we are authorised to transfer personal data (i.e. name, address, date of birth, amount of payment and fees) to the credit agencies InFoScore Consumer Data GmbH, Rheinstrasse 99, 76532 Baden-Baden (Germany), SCHUFA Holding AG, Geschäftsstelle Berlin, Mariendorfer Damm 1-3, 12099 Berlin and/or Informa Unternehmensberatung GmbH, Freiburger Strasse 7, 75179 Pforzheim. The personal data may be saved, stored and processed in accordance to the purpose of credit assessment. Information about the user’s creditworthiness may be obtained by mathematical and/or statistical algorithms from the named credit agencies. We are authorised to limit the bets including the fees per Challenge or tournament or day beforehand, individually or generally.   5.7. Fees: We levy fees on support the games and the accounts management as handling charge. The gain announced by the eDuel-system after user’s choice of type of Challenge and bet, is the the net gain. At any pay out we charge the user 1,00 Euro for it. Bank charges have to be born by the user.   5.8. Clearing: Gains, bets and fees will be set against the credit account of the user by us.   6. General Principles of Use and Ban of Abuse   6.1. User’s abuse is on hand, for example,   by deliberate misrepresentation by opening more than one account or by opening an account unjustified by fraudulent action, for example, by perturbation of data processing due to scripts, any other mechanisms or software, by intentional disruption to bias the game, by unfair behaviour, e.g. pretence other users, to take advantage of this pretence or jeopardising a fair game by collusive cooperation to damnify inexperienced and not adept users. by violation of any regulations of us.   At abuse we are entitled to limit the user’s attendance. We may also block or close the user account, refuse the access, deduct all gains, and claim reimbursement of expenses caused by the user’s abuse. All these rights are also reserved if there is a strong suspicion of abusing.   6.2. In case of any suspicion of abuse arisen during the course of the game we may stop or quit a game. If abuse pursuant to 6.1 is detected we may declare the game invalid afterwards.   6.3. Users may contact or defy each other in the community. It is forbidden to exchange impertinent, libeling, offensive, pornographic or any other explicit content. We will ban users violating this regulation and close their user accounts.   7. Revocation and cancellation   7.1. The user’s right of withdrawal or revocation is limited to two weeks since opening the user account. This right will cease on this moment the user starts or participates in his or her first Challenge or tournament. The withdrawal has to be in written form (see address below) or by e-mail to eDuel.net.   7.2. The user may cancel his account by e-Mail to eDuel.net. He or she has to finish all Challenges or tournaments before he or she does so. The credit will be paid out after a processing time of about 30 days. If the balance is more than 15,00 Euro pay outs will be conducted. Smaller amounts cannot be paid out due to administrative expenses.   7.3. We may terminate the agreement between the user and us without giving reasons and at once. If the user is inactive for more than 12 months we are authorised to close his or her account. If there is a credit balance we will inform the user to encourage him to demand the pay out.   8. Liabilities and corrective action   8.1. Limited Liability: We are not liable for any loss, damage or injuries by using eDuel.net, unless it is caused by us with gross negligence or intention. We are only liable for loss, damage or injuries caused by our factors, servants and assignees when committed with gross negligence or intention unless contractional agreements are violated.   8.2. Errors or Malfunction: We are not liable for any errors caused by misentries, transmission errors, erroneous interpretation or evaluation of data.   8.3. We are not liable for any indirect damage, consequential loss or damage caused by other user’s abuse. If users quarrel with each other over the result of a Challenge or a tournament we will provide game administrators who will examine the course of the game and come to a decision by Implementation of evidences (screenshots, replays and demonstrations).   8.4. Misstatements: We reserve our right to revise apparent or obvious mistakes at the announcement of bets, fees, quotas et al. A revision may be applied subsequently.   8.5. Abuse: We are not liable for any damage, loss or injury caused by misuse of a user account by players or others.   8.6. If the game has to be aborted the game may be repeated unanimously. If the game’s participants cannot agree on a replay the game administrators will decide.   8.7. Gains: We are not liable for the loss of any profit or expected profit, even though the game is aborted.   8.8. We are not liable for any loss caused by abuse of the user’s credit card or any other method of payment by a third person.   9. Game administrators   9.1. In certain cases the game administrators will be provided by us to come to a decision by evidences (screenshots, replays or demonstrations). These decisions are binding and incontestable. All expenses due to the risen protests may be carried to the causer’s account or be set against the causer’s credit balance.   10. Protection of data privacy   10.1. We will only collect, save or store, process or use personal data with the user’s consent or in accordance with the Bundesdatenschutzgesetz (federal protection of data act) or any other law concerning personal data.   10.2. The user agrees to the announcement of his username, the score and the game’s log by opening his user account.   10.3. If the user succeeds in a tournament, he agrees to the announcement of data towards a third person to afford a identification of his person. This agreement is intended to be used in a case that we have to bring evidence of the results of game towards other users.   11. Written Form, Change of this agreement   11.1. All declarations or statements regarding the usage of eDuel.net have to be in written form or may be negotiated by e-mail. Our e-mail-address is info@eduel.net.   11.2. Change of Agreement: We reserve our right to change this agreement at anytime and without giving reasons. Changes of this agreement or the announcement of change will be sent to all users by us and by e-mail. The e-mail may announce a how-to where the changes are available. Such an e-mail will be sent at least two weeks since coming into effect. Unless the user does not agree to the change he or she has to send his objections to us within two weeks otherwise the changes will apply. If the user dissents the amendment, we may cancel the full agreement due to section7.   12. Severability clause       12.1. In the event that any term of this Agreement is held to be invalid or unenforceable by judicial decree or decision, the remainder of this Agreement shall remain valid and enforceable.   13.
